Suspect In Elizabeth Smart Kidnapping Ruled Mentally Incompetent POSTED: 4:27 pm EDT July 26, 2005 UPDATED: 6:15 pm EDT July 26, 2005 SALT LAKE CITY -- The man charged in the kidnapping of Utah teenager Elizabeth Smart was declared mentally incompetent to stand trial Tuesday. The decision by Judge Judith Atherton will send Brian David Mitchell to a state hospital until he is deemed capable of standing trial. Atherton issued her decision after six days of hearings over the past seven months. Mitchell repeatedly shouted Biblical admonitions and sang hymns during the hearings, prompting him to be removed from court several times. The judge's decision covered the sweep of Mitchell's life in a family that testimony showed had a history of mental disorders. Mitchell was the third of six children and a "loner" in a "highly dysfunctional" family, the judge wrote. Mitchell, 51, is accused of kidnapping then 14-year-old Elizabeth from her bedroom in 2002, sexually assaulting her and keeping her as his second wife. Mitchell and wife Wanda Barzee, 59, were charged with kidnapping, aggravated sexual assault, aggravated burglary and attempted aggravated kidnapping. Elizabeth Smart's Dad Wants Suspect Locked Up POSTED: 12:40 pm EDT July 27, 2005 UPDATED: 12:48 pm EDT July 27, 2005 SALT LAKE CITY -- The father of Utah teenager Elizabeth Smart said he doesn't believe the man accused of kidnapping her will change. So Ed Smart hopes Brian David Mitchell will stay in a mental hospital, now that Mitchell has been declared incompetent to stand trial. The 51-year-old is accused of kidnapping the then-14-year-old Elizabeth from her bedroom in 2002, sexually assaulting her and keeping her as his second wife for months. Police said the teenager was found nine months later walking with Mitchell and his wife, Wanda Barzee. Ed Smart said his only satisfaction would be in knowing Mitchell won't be released to hurt anyone again. Judge Judith Atherton has committed Mitchell to a state hospital for treatment aimed at restoring his competency. The decision came after six days of hearings over the past seven months. During those hearings, Mitchell repeatedly shouted Biblical admonitions and sang hymns. He was removed from court several times. Mitchell and Barzee have both been charged with kidnapping. Barzee was earlier found to be incompetent -- and is being treated at a state hospital. Elizabeth is now 17.
